Can I Offer a Bonus With Conditions?

Offering a bonus on your listing is a great way to incentivize your fellow REALTORS®. Bonuses can be listed under the field "Bonus" in the "Office/Sales" section in your draft. You may also advertise your bonus in the agent remark. When advertising or offering a bonus, the only thing you cannot do is have a contingency on an agent receiving the bonus.

Examples of a contingency: 
1. $5,000 agent bonus if we close by the end of X month. 
2. $5,000 agent bonus if you use our preferred title company, inspector and appraiser. 
3. $5,000 agent bonus for a cash offer. 

These rules pertain to commissions as well. You cannot have a contingency for an agent to receive a commission. 

MLS Rules and Regulations:
Section 16.18-MLS Participants, acting as subagents or buyer/tenant representatives or brokers, shall not use the terms of an offer to purchase/lease to attempt to modify the listing broker's offer of compensation to subagents or buyer/tenant representatives or brokers, or make the submission of an executed offer to purchase/lease contingent on the listing broker's agreement to modify the offer of compensation.
